Drivers smartwatch use risk - law ‘unclear’

1 Jul 2026

Drivers are being warned that they risk falling foul of the law by using their smartwatch while behind the wheel.

Legislation governing mobile phone use while driving makes it an offence to simply touch a device while in control of a vehicle, even when stationary in traffic.

However, while the law is less clear cut on what constitutes ‘use’ of a smartwatch, the RAC warns that touching, looking at and using voice command on such devices are all still potential causes of distraction.

In theory, it says that clearing a notification while driving could be covered by the offence of using a handheld phone behind the wheel, which carries the penalty of six points and a £200 fine.
